Agreement to Terms

Welcome to Mentor MD. These Terms of Service ("Terms") constitute a legally binding agreement between you and Mentor MD ("Company," "we," "us," or "our") governing your access to and use of the Mentor MD platform, including our website at www.mentormd.com and all related services (collectively, the "Platform").

By accessing or utilizing the Platform, you acknowledge that you have read, understood, and consent to be bound by these Terms. If you disagree with any provision of these Terms, you must discontinue use of the Platform immediately.

Description of Services

Mentor MD operates an artificial intelligence-powered clinical decision support platform designed to assist healthcare professionals with evidence-based medical information. Our services include access to synthesized clinical guidelines, peer-reviewed research summaries, drug interaction databases, and educational medical content.

The Platform is accessible through www.mentormd.com and associated web domains, mobile applications, and API integrations where available.

Eligibility and Account Registration

To utilize the Platform, you must be at least 18 years of age and possess the legal capacity to enter into binding agreements. Healthcare professionals using the Platform for clinical purposes must maintain valid professional licensure in their respective jurisdictions.

When creating an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Sharing, transferring, or selling account access is strictly prohibited.

Permitted Use

You agree to use the Platform solely for lawful purposes and in compliance with these Terms. The following activities are expressly prohibited:

  • Using the Platform for any unlawful, fraudulent, or malicious purpose
  • Attempting to circumvent, disable, or interfere with Platform security features
  • Conducting automated data extraction, scraping, or harvesting operations
  • Redistributing Platform content without proper attribution and authorization
  • Using the Platform to develop competing products or services
  • Impersonating any person or entity or misrepresenting your affiliation
  • Transmitting harmful code, malware, or disruptive content

AI Processing and Third-Party Services

Mentor MD incorporates artificial intelligence technology provided by Anthropic (Claude AI) to power its clinical support features. By using the chat functionality, you acknowledge and agree that:

  • Your medical queries, attached images, and recent conversation history will be processed by Anthropic's Claude AI to generate responses.
  • Medical keywords derived from your queries will be searched on PubMed (NIH) and DailyMed (FDA) to retrieve verifiable scientific sources.
  • All data transmission is encrypted and your data is not used to train AI models.
  • AI-generated responses are for educational purposes only and do not constitute medical advice, diagnosis, or treatment.

Medical Information Disclaimer

IMPORTANT: The information provided through the Platform is intended solely for educational and clinical decision support purposes. It does not constitute medical advice, diagnosis, or treatment recommendations.

Healthcare professionals must exercise independent clinical judgment when utilizing Platform information in patient care. The Platform is designed to supplement, not replace, professional medical expertise and the physician-patient relationship.

Never disregard professional medical advice or delay seeking treatment based on information obtained through the Platform. In emergency situations, contact emergency services immediately.

Professional Responsibility

Users who are healthcare professionals acknowledge that they bear full responsibility for clinical decisions made in the course of patient care. The Platform serves as an informational resource and does not assume responsibility for clinical outcomes.

You agree to verify all clinical information through appropriate channels before application in patient care settings. The Company does not guarantee the accuracy, completeness, or timeliness of any information provided.

Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, algorithms, and software, are the exclusive property of Mentor MD, Inc. or its licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal or professional purposes in accordance with these Terms. Any unauthorized reproduction, distribution, or modification of Platform content is prohibited.

User-Generated Content

The Platform may permit you to submit queries, feedback, or other content. You retain ownership of your original content but grant us a worldwide, royalty-free license to use, process, and analyze such content for Platform improvement and service delivery.

You represent that any content you submit does not violate the rights of any third party and does not contain confidential patient information unless appropriate consent and safeguards are in place.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENTOR MD AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, regardless of whether we were advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Mentor MD and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email with reasonable advance notice. Your continued use of the Platform following such modifications constitutes acceptance of the updated Terms.
